State Attorneyâs Section
The alliance developed between an investigator and the state attorneyâs office, as well as the state attorneys that will be assigned to prosecute your cases, is crucial in order to bring a case to trial. The legal aspects of an investigation are fundamental components in order to affect an arrest of an individual or individuals that have been linked by various means to a homicide investigation. As an investigator, you must examine every aspect of a case in order to provide the best possible answers as to who, what, where, when, and how a violent incident, such as a homicide, took place. It is also the responsibility of the investigator to follow every lead possible and never leave a lead by the wayside. An investigator must remember that they are to investigate each case thoroughly and objectively. Investigations should never become personal when justice is the ultimate goal, which it is. Investigators need to understand that during the course of investigating a violent incident, evidence may be obtained that clears a possible suspect or subject, thus, this exculpatory evidence needs to be brought to light in order for justice to be served. An investigatorâs reputation carries a lot of weight as relationships are developed with the judicial system. It is better to delay making an arrest until such time that additional evidence has been developed, as opposed to making a hasty arrest and later finding out that a wrong person had been jailed (removal of oneâs freedom). Investigators should never be in a hurry to make an arrest; they should be slow and methodical, in order to present the best case in trial. Therefore, a good working relationship must be developed during the course of an investigation, between the investigator and the prosecutor assigned to assist, in order to expedite any legal aspects of the investigation.
It has been my privilege to work with dedicated professionals assigned to the Miami-Dade State Attorneyâs Office. With their guidance, I have been able to obtain a better understanding of the law, its power, and how to responsibly use it in order to bring about positive results during the course of an investigation. Attorneys such as David Waksman, Gary Winston, Gail Levin, Michael Van Zampft, Alejandra Lopez, Frank Ladee, and Abe Lasser were positive influences in my career. Their willingness to impart their knowledge of the law allowed me to have a better understanding of how vehemently cases are to be investigated in order to achieve a successful prosecution. An investigator is not going to earn a Juris Doctorate from reading this section, but it will help develop a good understanding of what is needed (legally) to successfully investigate a violent crime, or any other crime for that matter.
